Federal Judge Mandates Freedom of Abrego Garcia from Immigration Custody
A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment lacks lawful basis.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.
The situation originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an error. Following his repatriation to the United States to answer human smuggling allegations, he was detained in federal detention.
In her decision, the judge noted that the government lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

The legal proceedings center on conflicting assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.
He has also entered a not guilty plea to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.
